Purpose

To consider an application for planning consent for a proposed winery and cellar sales on Location 2602 Bolganup Dam Road, Porongurup.

Background

The subject land comprises 3.6 hectares and is situated on a tourist route between the Mount Barker-Porongurup Road and the Porongurup National Park accessing holiday accommodation and an existing winery along the way.

The land is zoned "Rural" in Town Planning Scheme No.3. The surrounding uses of the subject land are rural, mainly pasture related. The nearest dwelling is approximately 300 metres to the east of the winery. Jingalla Wines is located approximately 300 metres to the north on Bolganup Road. Therefore the proposed winery and cellar sales will complement existing surrounding land uses.

Bolganup Dam Road is sealed and capable of accommodating the increased traffic as a result of the winery / cellar sales. Access to the site will be from Bolganup Dam Road in compliance with Council requirements.

A water pipe from the nearby Water Corporation storage dam and pump station runs along the western side of the Bolganup Road reserve. However, in addition to accessing this supply the developers plan to establish fresh water storage from roof runoff.

Overhead power lines currently run through the subject land to the south of the proposed development in an east-west direction.

All waste disposal facilities will be designed and constructed to Health Department, and if necessary Department of Environmental Protection, Standards. Details will be provided as part of the building application.

Consultation

There has been consultation with the applicant in regard to the requirements of the Town Planning Scheme requirements.

Policy Implications

Council Policy P.B.1 stipulates a minimum setback of 20 metres from the front boundary and 10 metres from all other boundaries in the Rural Zone. The proposal complies with these requirements.

Town Planning Scheme Policy Statement No. 6 requires that non-reflective materials, which blend with the landscape, be used on the external walls and roofs of all buildings in the Porongurup Area to the satisfaction of the Principal Health/Building Officer. Water tanks and outbuildings may be exempted subject to them being screened from view to the satisfaction of the Council.

Town Planning Scheme Policy Statement No.11 - Porongurup Rural Strategy (1997), divides the Porongurup area into various planning precincts. The land is located within precinct B2 of the Porongurup Rural Strategy (1997) and is therefore subject to the requirements of Town Planning Scheme Policy Statement No. 11.

Officer Comment

The proposed 'Fernbrook Estate' winery and cellar sales are an ideal location. It is on a major tourist route to the Porongurup National Park and complements nearby holiday accommodation and an existing winery.

This report has demonstrated that the proposed winery and cellar sales to be established on Plantagenet Location 2602 Bolganup Road, Porongurup will comply with the statutory, policy, and strategic planning requirements. The necessary infrastructure to support the development is available. This includes easy access to Bolganup Dam Road, a sealed road at a suitable standard to cater for the increase in traffic from the proposed development, and availability of scheme water and power.

Only concept plans have been presented as part of the planning proposal. An architect is currently preparing more detailed plans of the winery/cellar sales in compliance with planning, development, building and health requirements and will be submitted as part of the building application to Council in the near future.

That planning consent be granted in respect of Application No. 38/02 for a winery and cellar sales facility on Location 2062 Bolganup Dam Road Porongurup in accordance with the plans dated 10 December 2002 subject to the following conditions:

(1) All stormwater runoff from the development is to be disposed of onsite to Council's satisfaction.
(2) Waste products associated with the Winery shall be adequately disposed of and shall not result in any nutrient export from the site.
(3) Commercial rubbish must be screened from public view in a location acceptable to Council.
(4) Compliance with relevant health and building requirements.
(5) Compliance with the 10-metre side setback standard of Policy P.B.1 for the Rural Zone in Town Planning Scheme No. 3.
(6) The external walls and roof being constructed of non-reflective materials, which blend with the landscape.
(7) An approved on-site effluent disposal system to the satisfaction of the Health Department of WA and the Principal Environmental Health / Building Officer will be required to service the development.
(8) This approval is valid for a period of 24 months.
ADVICE NOTE

(1) If the development, the subject of this approval, is not substantially commenced within a period of 24 months, the approval shall lapse and be of no further effect. Where the approval has lapsed, no development shall be carried out without further approval of Council having first been sought and obtained.
