Code of Practice










1. MARKETING

Earthworks Training and Assessment Services (ETAS) will market their educational products with integrity, accuracy and professionalism. All promotional literature and marketing materials published by or on behalf of ETAS in whatever form, will be truthful, accurate and unambiguous.
- Before information about an individual is used in any marketing that individual must have provided written permission to this organisation;
- Advertisements referring to Registered Training Organisation status will clearly identify the products and services covered by the scope of registration;
- This organisation will only advertise AQF qualifications once it is registered to issue those qualifications;
- Advertisements will identify nationally recognised products separately from courses recognised by other bodies or without recognised status;
- The names of training packages, qualifications or accredited courses used in advertising materials will be consisted with the names and/or titles recognised by the Training Accreditation Council.
- Marketing or promotional literature and general media advertising will not:
- encourage unrealistic expectations about the level of qualifications attainable and the facilities and equipment provided; or
- make claim to approval or recognition that is inaccurate or use misleading or false comparisons of courses with others provided by competitors; or
- Make misleading statements concerning the qualifications or experience of staff; or
- Make misleading or false statements about the prospects of employment following the course.


2. COURSE INFORMATION

ETAS will provide sufficient and accurate information to course participants that sets out the detail of the total costs/fees and the objectives, assessment procedures and competency standards and outcomes to be achieved by course participants. Information provided by ETAS to course participants about courses will include the following:
- A description of the course, content and vocational outcomes;
- Fees and charges including refund policy payable to ETAS
- Flexible learning and assessment procedures, including provision for language, numeracy & literacy assessment;
- Recognition of Prior Learning / Skills Recognition arrangements;
- A description of the credential or statement of attainment to be given on completion of the course;
- A statement as to whether the course is recognised by industry or professional organisations, public institutions or government authorities;
- A description of course participant support services including welfare and guidance services;
- Information on appeals, complaints and grievance procedures;
- Disciplinary procedures;
- Staff responsibilities for access and equity, and
- Any pre-course requisites.



3. RECRUITMENT

Recruitment of course participants will be conducted at all times in an ethical and responsible manner. Recruitment decisions will rest on assessment by institutions of the extent to which the stated competency standards and outcomes of the course are likely to be achieved by the applicant given his/her qualifications, proficiencies and aspirations.

ETAS will provide documentation to prospective course participants which discloses in full all of the contractual arrangements between ETAS and the student. This documentation will be written in clear, concise, plain English which avoids vague and ambiguous clauses.

ETAS will make available, in writing, all information concerning fees and charges to course participants and the refund policy prior to their completion of any enrolment agreement or contract.


4. REFUND POLICY
Cancellations and requests for refunds must be made in writing and are generally only accepted if cancellation is made before 5pm on the day enrolments close. Other refunds are made solely at the discretion of (Organisation)'s management after taking into account the reason for the request.


5. FLEXIBLE DELIVERY & ASSESSMENT

Course participants will be advised of the most applicable form of delivery for each course. In many situations this will be off the job in a group training situation, in a facility large enough to accommodate the maximum number of course participants with adequate room to conduct the practical examination portions of the class following each module, with individual seating / desk / bench top availability. Locations will vary according to arrangements made with participants and employers.

ETAS undertakes to provide assessment of training:
- in accordance with the national Assessment Competency Standards;
- in accordance with the WA State Training Board's Framework for Competency Based Assessment: in Vocational Education and Training in Western Australia;
- in accordance with the national principles of assessment (eg. valid, reliable, flexible and fair); and
- in accordance with the assessment guidelines of any Training Packages and accredited courses which ETAS may seek to register within its scope.
- in accordance with language, literacy and numeracy needs of course participants.

Skills Recognition (RPL) will be provided which acknowledges skills and knowledge obtained through:
- formal training (conducted by industry or educational institutions in Australia or overseas)
- work experience (informal training), and
- life experience.

6. APPEAL and GRIEVANCE MECHANISMS

Should the need arise, ETAS will ensure that course participants have a fair mechanism for appealing disputed assessment decisions or grievances that arise in non-assessment situations.

7. ACCESS & EQUITY POLICIES

As a training organisation, ETAS will comply with its legal and moral duty to respect the rights and beliefs of course participants and staff through avoidance of discrimination, recognition of the special needs of clients and course participants, physical access to courses, remediation and bridging programs, mentoring, culturally appropriate behavior, and equal opportunity. All access and equity issues to be directed to the Administration Manager.

8. WELFARE AND GUIDANCE SERVICES

ETAS aims to ensure that every participant gains the maximum benefit from participating in a particular course or program. Management practices are implemented that safeguard the interest and welfare of learners in all training and assessment situations.

All staff are highly qualified and experienced personnel who give course participants support, advice and counseling whenever needed. Course participants who are unable to attend classes due to illness or work commitments are given free catch up lessons and participants who fall behind or are experiencing difficulties are given assistance to catch up.
